These Terms and Conditions (“Terms”) govern your access to and use of the websites, mobile applications, QR code–based services, and related offerings (collectively, the “Platform”) provided by ScanGuard Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at [Insert Address], New Delhi, India (“Company,” “we,” “us,” or “our”). By using the Platform or any service offered by the Company, you agree to be bound by these Terms.
If you do not agree with any part of these Terms, you must immediately discontinue use of the Platform and services.
“User” or “You” means any natural or legal person who accesses the Platform, purchases a QR tag, avails challan settlement services, or otherwise interacts with the Company’s services.
“Services” means the QR-enabled vehicle tags, masked communication facilities, challan assistance, and any other ancillary services provided by the Company.
“QR Tag” refers to the physical or digital quick-response code affixed to a vehicle that enables communication without disclosing personal contact details.
“Challan Settlement Service” means the Company’s assistance in facilitating the settlement of traffic challans, including documentation, payment processing, and liaison with authorities, subject to applicable laws.
“Platform” includes the Company’s website, mobile application, and any associated interfaces.
By registering, purchasing, or using the Services, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. The Company reserves the right to modify these Terms at any time without prior individual notice. Your continued use of the Services after any change constitutes acceptance of the revised Terms.
3.1 QR Tags & Communication
The Company provides QR tags that enable third parties to contact vehicle owners through masked calls, SMS, or WhatsApp without revealing the owner’s personal number. The Company does not guarantee that every scan will result in successful communication, as connectivity depends on factors beyond its control.
3.2 Challan Settlement Assistance
The Company offers a paid service to assist Users in settling traffic challans, including availing permissible discounts (up to 50%, where applicable). The Company acts solely as an intermediary facilitator. Final settlement is subject to the discretion of the relevant traffic authority or court. The Company does not guarantee that any challan will be dismissed, reduced, or settled, nor does it provide legal advice.
3.3 No App Requirement
The Services are designed to function without mandatory app installation; however, certain features may require the use of a mobile device with internet connectivity and a compatible browser.
You agree to:
Provide accurate, current, and complete information during registration or when using the Services.
Not use the QR Tag or communication features for any unlawful, harassing, fraudulent, or abusive purpose.
Not reverse engineer, decompile, or attempt to extract the source code of any part of the Platform.
Not misuse the challan settlement service by providing false documents or misrepresenting facts.
Comply with all applicable central and state laws, including the Motor Vehicles Act, 1988 and the Information Technology Act, 2000.
The Company reserves the right to suspend or terminate access to Services if it reasonably believes a User has violated these Terms.
All intellectual property rights in the Platform, including but not limited to trademarks, logos, software, QR code technology, content, and design, are owned solely by the Company or its licensors. No license or right is granted except as expressly stated. You may not copy, reproduce, distribute, or create derivative works without prior written consent.
Your privacy is important to us. Our collection and processing of personal data is governed by our Privacy Policy, which forms an integral part of these Terms. By using the Services, you consent to the collection, storage, and use of your data as described in the Privacy Policy, including for masked communication and service delivery.
7.1 Fees
Certain Services, such as challan settlement assistance, are provided on a paid basis. All fees are disclosed before confirmation and are non-refundable unless otherwise required by law.
7.2 No Refund Policy
Once the Company has initiated the challan settlement process or delivered the QR Tag, no refunds shall be provided, except in cases where the Company fails to provide the service due to its own error. Disputes regarding the outcome of a challan settlement (e.g., discount not granted) shall not entitle the User to a refund.
7.3 Third-Party Payments
Any payments made to government authorities or third parties as part of the challan settlement are passed through; the Company is not liable for delays or rejections caused by such authorities.
The Company assists in the settlement process but does not guarantee any specific result, including reduction or waiver of penalty.
You must provide all necessary documents and authorizations. Failure to do so may result in non-completion of the service.
The Company may engage third-party agents or legal professionals to facilitate the process. Such engagement shall be at the Company’s discretion.
Any discount availed is subject to government schemes, and the Company does not assume responsibility if a discount is not applicable.
The Company shall not be liable for any fines, penalties, or legal consequences arising from the underlying traffic violation, which remain your sole responsibility.
The QR Tag is provided “as is.” The Company does not warrant that it will be indestructible, weatherproof, or functional under all conditions.
You are solely responsible for affixing the QR Tag to your vehicle. The Company is not liable for any damage to the vehicle or tag during installation.
The Company may, at its discretion, deactivate a QR Tag if it is used for any unlawful purpose, reported stolen, or upon request by law enforcement.
To the maximum extent permitted under Indian law:
The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
The Company does not warrant that the Platform will be uninterrupted, error-free, secure, or free from viruses.
The Company does not endorse, verify, or guarantee the accuracy of any information provided by third parties, including traffic authorities.
11.1 To the fullest extent permitted by law, in no event shall the Company, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with the use of or inability to use the Services.
11.2 The Company’s total aggregate liability for any claim arising from or relating to these Terms or the Services shall not exceed the total amount paid by you to the Company for the specific service giving rise to the claim, or Rs. 1,000 (whichever is lower), unless otherwise mandated by law.
11.3 The Company shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to government actions, court orders, technical failures, or force majeure events.
You agree to indemnify, defend, and hold harmless the Company and its officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in connection with:
Your breach of these Terms;
Your misuse of the QR Tag or challan settlement service;
Any violation of applicable laws by you;
Any dispute between you and a third party arising from use of the masked communication feature.
13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of India.
13.2 Jurisdiction
Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts at New Delhi, India.
13.3 Arbitration
Notwithstanding the foregoing, the Company may, at its sole discretion, elect to resolve any dispute through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a sole arbitrator appointed by the Company, and the seat of arbitration shall be New Delhi. The language of arbitration shall be English. The arbitration award shall be final and binding on both parties. The User agrees to waive any right to pursue claims in a consumer forum or before any tribunal where such waiver is permissible under law, and agrees that arbitration shall be the exclusive mechanism for dispute resolution.
The Company reserves the right to suspend or terminate your access to the Platform or Services at any time, without notice, for any reason, including but not limited to breach of these Terms or suspected fraudulent activity. Upon termination, your right to use the Services ceases immediately.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and the Company regarding the Services and supersede any prior agreements.
